Delta County Clerk of Court Split

Delta County has two clerk concepts that should not be blended. Sherry Kuhn is the Clerk of Court and Probate Registrar for Delta County in the Colorado Judicial Branch. That office handles court records, case files, filings, probate registrar work, dockets, court copies, and records tied to District Court and County Court. Delta County Clerk and Recorder Teri A. Stephenson is a separate county official. The Clerk and Recorder handles recorded documents, marriage and civil-union records, selected vital records, elections, vehicle title and registration, plats, land records, liens, easements, board records, and recording functions. A marriage license copy goes to that office. A divorce decree, criminal disposition, probate letter, traffic ticket record, or civil judgment copy goes to the Clerk of Court.

The Clerk of Court counter is the in-person fallback for court records. Delta County's records routing material says court records are maintained by the Colorado Judicial Branch and must be requested at the Court Clerk's Office on the third floor of the courthouse or through Judicial Branch court-record channels. Certified copies, full case documents, divorce decrees, probate records, dispositions, and file-specific papers are court clerk matters.

Request Delta County Court Copies

There are three main court-record request channels. The statewide Judicial Branch record/document request form is the online route for case documents, divorce decrees, dispositions, registers of action, probate documents, and certified or exemplified copies. The courthouse counter is the in-person route. CoCourts may provide a register of actions, but commercial access does not provide document copies.

1. Identify the court record type, such as divorce, felony, misdemeanor, probate, traffic, civil, protection order, or small claims.
2. Gather the case number, filing year, Delta County location, party names, and date of birth if known.
3. Select the requested document, such as decree, disposition, ticket, will, letters, order, or register of actions.
4. Check certified or exemplified copy if the copy must carry court certification.
5. Submit the online form or contact the Clerk of Court counter for in-person handling and fee instructions.

The request form states that responses are usually within three business days unless extenuating circumstances exist. Suppressed cases, juvenile records, probate records, and documents with confidential or protected information may require U.S. government-issued photo ID.

The Clerk and Recorder context is useful because many people ask the wrong clerk first. Delta County's recording information page lists county recording and copy fees for recorded-document work.

Those fees cover county recording records, not court case files, so they help show why the custodian split matters.

The Clerk and Recorder's Tyler portal is for recorded-document public access. Its visible disclaimer says data can change without notice, that users should search spelling variations and other criteria, and that the index is like a library card catalog rather than the document itself.

That portal is useful for recorded instruments, while court decrees and dispositions still require Judicial Branch channels.

Certified Delta County Court Copies

A certified court copy is used when the requester needs the court's official certification on a document. Common Delta County examples include divorce decrees, criminal disposition or sentence orders, probate letters, civil judgments, satisfaction documents, and traffic case records. Certified copies are different from unofficial online search results or commercial register-of-actions data.

For a certified copy, identify the exact document. A request for a register of actions is not the same as a request for a decree, order, ticket, will, or disposition. If a record includes confidential material, court staff may redact protected information or require ID before release. If the case file is old or stored off-site, actual retrieval cost may be added.

Delta County Clerk Forms

For self-represented filings, the Colorado Judicial Branch self-help forms library is the statewide source. It includes family, probate, civil, criminal, protection order, and other court process forms. Delta County filings then route to the Combined Court when the case belongs in Delta County.

County administrative records use a different path. Delta County NextRequest is used for county CORA requests, while the county records routing page says court records, law-enforcement case records, and municipal records have separate custodians. That means a requester should first decide whether the record is a court case file, a county recorded document, a sheriff record, a county administrative record, or a municipal record.

That first decision saves time at the counter. The offices share the courthouse address, but the legal custody of the records is different.

The same split applies to open-records requests. Delta County's general CORA portal is useful for county administrative records, but the research states that court records are state Judicial Branch records with different requirements. Sheriff's Office criminal-justice records also use a separate records-management process and fee schedule. A complete record search may require more than one custodian when a court case, sheriff report, and county administrative record are all tied to the same event.

Older Delta County Court Files

Older court files may need more precise identifiers. The request form allows a filing-year selection that reaches back to 1873, but a broad name search can still be slower than a targeted request. Case number, filing year, party names, case type, and Delta County as the location give court staff a better path to the right file. If the file is stored off-site, the Judicial Branch fee schedule lists actual retrieval cost.

Redaction can also affect timing. The form lists research and redaction after the first hour at $30 per hour in 15-minute increments. That charge matters when a record has protected information, a suppressed status, a juvenile issue, or a probate confidentiality concern. The Clerk of Court can process the request, but release still depends on Colorado court access rules and any order that applies to the case.
